RENTAL AGREEMENT
Current Micromobility Inc. Rental Agreement,
Waiver of Liability and Release
THIS AGREEMENT made as of the 18th day of July, 2025.
This Rental Agreement, Waiver of Liability, and Release (the “Agreement”) sets forth the legally
binding terms and conditions governing your use of any services provided by Current Micromobility Inc.,
operating as Current Inc. (“Current,” “we,” “us,” or “our”). By using any of the services described below,
you (“you,” “your,” or the “Rider”) acknowledge that you have carefully read, understood, and agreed to
be legally bound by this Agreement, including on behalf of your heirs, successors, assigns, agents,
affiliates, and representatives.
Current provides access to shared electric vehicles and related services through the Current App.
These services include, without limitation:
1) the rental and use of electric vehicles (each, a "Vehicle" and collectively, the &"Vehicles");
2) all related equipment, personnel, maintenance, and support services; and
3) the Current mobile application, website, and all content and information provided by
Current (collectively, the “Current Services”).
This Agreement incorporates and supplements any other terms you agreed to during sign-up,
including our Terms of Service and Privacy Policy. In the event of any conflict between those terms and
this Agreement, this Agreement shall prevail with respect to the use of Current Services.
NOTICE: This Agreement contains important provisions that affect your legal rights, including:
1) A waiver of liability and assumption of risk related to use of the Vehicles (see Section 3.3
and 12)
2) A mandatory arbitration agreement that limits your ability to pursue claims in court or on
a class-wide basis (see Section 6); and
3) Limitations on damages and Current’s liability to you.
Please read this Agreement in full before using the Services. If you are viewing this Agreement on a
mobile device with a small screen, you are encouraged to scroll carefully and review all sections.
1. INTERPRETATION
1.1 Definitions: In this Agreement, unless something in the subject matter or context is inconsistent
therewith:
(a) “Agreement” means this Rental Agreement, Waiver of Liability, and Release, including all
schedules and policies, as amended from time to time;
(b) “App” or “Current App” means the mobile application provided by Current Micromobility
Inc. that allows Riders to locate, unlock, rent, and return Vehicles, and access related
Services.
(c) “Current,” “we,” “us,” or “our” refers to Current Micromobility Inc., operating as Current
Inc., its employees, agents, affiliates, officers, directors, and contractors;
(d) “Current Services” means all services provided by Current, including (1) rental and use of
Vehicles, (2) maintenance and support services; (3) access to and use of the App and Website;
(4) related infrastructure and technology systems;
(e) “Designated Parking Area” means any authorized and approved location listed in the App
where a Vehicle must be lawfully parked at the end of the ride (Section 2);
(f) “Guest” means any individual who rides a Vehicle under the Group Ride feature, authorized
and supervised by a Host, and who has agreed to the terms of this Agreement;
(g) “Host” means the Rider who initiates and pays for a Group Ride, and who is responsible for
ensuring that all Guests comply with this Agreement;
(h) “Operating Area” or “Service Area” means the geographic area designed by Current
(currently limited to the City of Sarnia) where the Vehicles may be legally operated, parked,
and used;
(i) “Privacy Policy” means Current’s privacy policy as updated from time to time and made
available through the App or Website;
(j) “Promo Code” means a discounted code issued by Current that may provide promotional ride
credits, incentives, or discounted, subject to terms and conditions;
(k) “Released Person” means Current, its affiliates, employees, officers, directors, contractors,
partners, agents, municipalities, and property owners involved in providing or supporting the
Services;
(l) “Rider,” “you,” or “your” means the individual entering into this Agreement, registering an
account, and/or using the Current Services or any Vehicles, including any person who
authorizes or initiated a Group Ride;
(m) “Ride” or “Trip” means each individual instance of unlocking, using, and completing use of a
Vehicle via the App;
(n) “Terms of Service” means the terms and conditions posted on the App or Website that
governs use of the Current platform and supplement this Agreement;
(o) “Vehicle” means any electric scooter, e-bike, or other micromobility device made available
by Current for rental under this Agreement, including accessories, hardware, or technology
affixed thereto;
(p) “Website” means the official website of Current Micromobility Inc., accessible at
www.ridecurrent.ca, which provides information about the Services and access to this
Agreement.
2. RIDE COMPLETION AND CHARGES
2.1 You must end your ride using the Current App at the conclusion of each trip. Until you properly
end the ride within the App, charges will continue to accrue. In such cases, the maximum charge
for a single ride is $100 for a 24-hour period. See Section 5.3 for additional details.
3. PARKING AND USE OBLIGATIONS
3.1 When ending your ride, the Vehicle must be parked in a lawful and permitted public location.
3.2 Parking is prohibited on:
(a) Private property without express authorization;
(b) Locked or restricted access areas;
(c) Sidewalks, roadways, or areas obstructing pedestrians or vehicles; or
(d) Any area that violates municipal laws or regulations.
3.3 You must comply with all applicable laws and regulations, including but not limited to:
(a) Traffic laws;
(b) Parking regulations;
(c) Helmet use and safety rules; and
(d) Rules governing use of electric vehicles.
3.4 You agree to promptly report any damaged, unsafe, or malfunctioning Vehicles to Current via the
App or by contacting our support team.
3.5 Current agrees to rent, and you agree to use, the Vehicle in accordance with the terms and
conditions of this Agreement.
3.6 Unless otherwise specified, all monetary amounts referred to in this Agreement are stated in
Canadian dollars.
4. RENTAL POLICY AND USE OF VEHICLE
4.1 Sole Rider and User Responsibility
(a) The Rider acknowledges and agrees that they are the sole party to this Agreement and the
sole authorized user of any Vehicle rented under their account.
(b) The Rider shall not permit any other person to activate, operate, or use the Vehicle at any
time.
(c) The Rider accepts full responsibility for compliance with all terms and conditions of this
Agreement and for any use of the Vehicle during the rental period.
4.2 Age and Licensing Requirements
(a) The Rider represents, warrants, and certifies that they are at least sixteen (16) years of
age, in accordance with applicable laws for electric vehicle use in the Province of Ontario
and the City of Sarnia.
(b) The Rider further confirms they are legally permitted to operate the Vehicle and, where
required, possess a valid driver’s license or permit.
(c) The Rider must not be prohibited from entering into contracts under Ontario law.
4.3 Competency and Assumption of Risk
(a) The Rider represents and warrants that they are physically and mentally capable of
operating the Vehicle, are familiar with its use, and have reviewed all safety guidelines
provided by Current through the Current App and/or website.
(b) By choosing to operate a Vehicle, the Rider voluntarily assumes all risks and
responsibilities associated with its use, including any resulting injuries, damages, or
medical conditions.
(c) The Rider is solely responsible for evaluating whether weather, visibility, road, traffic, or
other environmental conditions make it unsafe to operate the Vehicle. The Rider is
advised to adjust riding behavior and braking distance accordingly.
4.4 Ownership of the Vehicle
(a) All vehicles, and any related equipment provided by or affixed by Current, remain the
exclusive property of Current at all times. The Rider shall not:
(i) Dismantle, repair, modify, or otherwise tamper with any part of the
Vehicle;
(ii) Remove, obscure, or deface any decals, markings, or branding on the
Vehicle; or
(iii) Use the Vehicle or associated equipment for advertising, promotional, or
commercial purposes without the prior written consent of Current.
4.5 Operating Hours and Vehicle Availability
(a) The Rider acknowledges that Vehicles are not guaranteed to be available at any particular
time or location and are not available 24 hours a day, 7 days a week, or year-round.
(b) Current may, in its sole discretion, require the Rider to return a Vehicle at any time and
reserves the right to suspend or terminate Vehicle availability temporarily or permanently
without prior notice.
4.6 Permitted Operating Area
(a) The Rider agrees to operate the Vehicle only within the designated service area (currently
limited to the City of Sarnia) and shall not ride, transport, or leave the Vehicle outside of
this area.
(b) Use of a Vehicle in any prohibited or no-ride zone is strictly forbidden and may result in
service suspension, fines, or retrieval fees.
4.7 Designated Parking Areas
(a) At the end of each ride, the Rider must return the Vehicle to an authorized designated
parking area as listed in the Current App.
(b) Designated parking zones include but are not limited to:
(i) City Parks: Centennial Park, Canatara Park, Rainbow Park, Germain
Park, Tecumseh Park, Mike Weir Park
(iii) Other Locations: Howard Watson Trail at Modeland Rd, Clearwater
Arena Bus Terminal, Lambton College, and Lambton College Residence
(b) Failure to return a Vehicle to a designated parking location may result in fees charged to
the Rider, including recovery costs and administrative charges. See Section 4 – Payment
and Fees for more details.
4.8 Compliance with Laws
(a) The Rider agrees to comply with all applicable federal, provincial, and municipal laws,
including but not limited to the Highway Traffic Act (Ontario), as well as all by-laws,
regulations, and safety requirements applicable to the operation and use of electric
vehicles. This includes, without limitation:
(i) Highway Traffic Act Compliance: The Rider shall comply with the
following provisions of the Ontario Highway Traffic Act and related
regulations:
(a) Operating while impaired by drugs or alcohol is strictly
prohibited.
(b) All Riders must wear a properly fitted helmet that meets
applicable safety standards.
(c) Riders under the age of 16 are prohibited from operating
any Current Vehicle.
(ii) Prohibited Use Areas: Riders shall not operate a Vehicle:
(a) On sidewalks;
(b) Within pedestrian crossovers when crossing streets;
(c) Within crosswalks at intersections or signalized
crossings.
(iii) Rider Etiquette and Courteous Use: The Rider agrees to conduct
themselves responsibly, courteously, and in accordance with safe riding
practices when using the Current Services. The following Rider Etiquette
Guidelines apply:
(a) Keep to the right-hand side of roads, trails, and paths;
(b) Ride at a safe, controlled speed, especially in shared
areas;
(c) Yield to pedestrians at all times;
(d) Pass only on the left, and do so slowly and with care;
(e) Use a bell or verbal signal when passing;
(f) Return and park the Vehicle only in designated parking
areas.
(b) Current reserves the right to suspend or revoke access to the Current Services at its sole
discretion if a Rider fails to follow any of the above laws, guidelines, or obligations.
4.9 Additional Rider Obligations: The Rider further agrees to the following conduct rules to ensure
safe and lawful use of the Vehicle:
(a) Do not operate the Vehicle while distracted, including the use of mobile phones, music
players, or other devices while riding.
(b) Do not carry or hold any items (including backpacks, bags, or briefcases) that could
impair your ability to balance or control the Vehicle. If you must carry such items, ensure
they are securely attached to your body and do not interfere with safe operation.
(c) Do not place objects (bags, items) on the Vehicle’s handlebars.
(d) Do not operate the Vehicle under the influence of alcohol, drugs, or any substance
(including medication) that may impair your judgment or motor skills.
(e) Do not carry passengers, including children or other persons.
(f) Do not add additional locks to the Vehicle or lock it in any way that is inconsistent with
Current’s instructions.
(g) Do not park the Vehicle:
(i) On unauthorized private property;
(ii) In locked or restricted-access areas;
(iii) Blocking sidewalks, driveways, or public rights-of-way;
(a) In any other non-public, unapproved, or unsafe location;
(b) In areas of high traffic where the Vehicle may pose a hazard or
risk being knocked over.
(vi) When parking, the Vehicle must be:
(a) Placed in an upright position, using the built-in kickstand; and
(b) Left in a location that is visible, accessible, and compliant with
the designated parking rules described in Section 2.
4.10 Impairment by Drugs or Alcohol
(a) You must not operate a Vehicle while under the influence of alcohol, drugs, or any other
substance that may impair your ability to operate the Vehicle safely. Impaired operation
of a Vehicle constitutes a criminal offence under the Criminal Code of Canada, pursuant
to 2018, c. 21 (Bill C-46).
(b) If you operate a Vehicle while impaired by alcohol, drugs, or a combination thereof, you
may be subject to criminal prosecution and penalties to the fullest extent permitted by
Canadian law.
4.11 Permitted Use and Restrictions
(a) The Rider agrees to use the Vehicle only for its intended and lawful purposes, and not for
any prohibited activities, including but not limited to:
(i) Racing, stunt riding, off-road or mountain riding, or trick riding;
(ii) Use on unpaved roads, through deep water, or in hazardous conditions
beyond normal urban travel;
(iii) Use in any area where operation of the Vehicle is prohibited or would
create a nuisance;
(iv) Use for commercial purposes, including for hire or reward, without
Current’s express written consent;
(iv) Use in violation of any applicable federal, provincial, or municipal law,
regulation, or by-law.
4.12 Weight and Cargo Limits
(a) The Rider must not exceed the Vehicle’s maximum weight capacity of 240 pounds (109
kilograms) unless otherwise specified.
(b) Overloading the Vehicle may affect its operation and safety and may void any applicable
warranty or insurance coverage.
4.13 Tampering and Unauthorized Use
(a) The Rider must not:
(i) Tamper with or attempt to gain unauthorized access to any part of the
Vehicle or Current’s systems;
(ii) Use the Current Services in any manner inconsistent with this
Agreement;
(iii) Alter or disable any GPS, tracking, security, or safety device installed on
the Vehicle.
4.14 Accidents, Damage, and Violations
(a) The Rider must promptly report any accident, damage, personal injury, traffic violation,
lost or stolen Vehicle, or any other incident involving a Vehicle to Current through the
App or via email.
(b) If the incident involves injury, property damage, or theft, the Rider must also file a police
report within 24 hours and provide Current with a copy.
(c) The Rider is solely responsible for any citations, fines, impound fees, or other penalties
arising from improper or unlawful use, including improper parking at the end of the ride.
(d) The Rider acknowledges that automobile insurance policies may not provide coverage for
use of electric micromobility Vehicles. It is the Rider’s responsibility to confirm coverage
with their insurer.
(e) Current reserves the right to cooperate with law enforcement and provide any requested
information regarding the Rider’s identity or activity, where permitted or required by law.
4.15 Return Condition and Responsibility for Damage
(a) The Rider agrees to return the Vehicle to Current in the same condition as received,
subject to normal wear and tear.
(b) The Rider is liable for any damage, loss, or theft occurring during the rental period,
including repair or replacement costs.
4.16 Electric Vehicle Operation
(a) The Rider acknowledges that the Vehicle is electric-powered and is subject to limitations
based on the level of battery charge. Specifically:
(i) Battery charge levels will vary and may decrease during use, potentially
reducing speed or stopping Vehicle operation entirely.
(ii) The charge level is not guaranteed at the start of a ride and may vary
based on the Vehicle, riding conditions, weather, or other external
factors.
(iv) It is the Rider’s responsibility to check the battery level before initiating
a ride and to ensure there is adequate charge to reach their intended
destination.
(iv) The Vehicle may lose power without warning, and Current is not liable
for any inconvenience, delay, or incident resulting from battery
depletion.
4.17 Prohibition on Charging Vehicles
(a) The Rider is strictly prohibited from attempting to charge or otherwise tamper with the
Vehicle’s battery or electrical system. If the Vehicle runs out of charge, the Rider must
end the ride using the Current App in accordance with this Agreement.
(b) Any Rider who attempts to charge the Vehicle does so entirely at their own risk and
assumes full responsibility for:
(i) Any resulting injuries, fire, property damage, or equipment damage;
(ii) Any related costs, claims, liabilities, penalties, or legal actions.
(c) Current, its affiliates, and service providers shall bear no liability for any damages or
losses arising directly or indirectly from unauthorized charging.
4.18 Mobile Device and Connectivity Requirements
(a) To access and use the Current Services, the Rider must use a smartphone or other device
compatible with the Current App. Some app functions (such as unlocking or ending a
ride) require:
(i) An active internet or mobile data connection;
(ii) Sufficient device battery level.
(b) Current is not responsible if a ride cannot be ended due to device failure, connection loss,
or battery depletion. In such cases, the Rider remains responsible for all charges until the
ride is properly ended.
4.19 Group Rides – Host and Guest Responsibilities
(a) Host Obligations: Current may permit a Rider (“Host”) to activate multiple Vehicles for
use by others (“Guests”) through the Group Ride feature. The Host agrees that:
(i) The Host is jointly and severally liable for compliance with this
Agreement by each Guest;
(ii) All charges, damages, or injuries arising from use of the Vehicles by
Guests are the Host’s responsibility;
(iii) Each Guest must read and agree to this Agreement prior to use;
(iv) All Guests must meet the minimum age requirement and licensing
requirements set out in Section 3.2;
(v) Each Vehicle may only be used by one person at a time;
(vi) The Host will pay for all Guest rides through their own account;
(vii) The Host is responsible for ensuring that all Vehicles are lawfully parked
at the end of use, and that any resulting fees (e.g., for improper parking)
are paid by the Host;
(viii) The Host must provide each Guest with a copy or opportunity to review
this Agreement.
(b) Guest Obligations: Prior to riding a Vehicle, each Guest must:
(i) Enter their email address in the Current App; and
(ii) Read and agree to all applicable terms and conditions of this Agreement.
5. PAYMENT AND FEES
5.1 Fees and Charges
(a) The Rider agrees to pay all fees associated with the use of the Vehicle as outlined in the
Current App. These may include:
(i) A ride start fee;
(ii) Fees calculated based on distance traveled and/or time used, rounded up
to the nearest minute;
(iii) A minimum fee per ride, where applicable.
(b) All fees are subject to change at Current’s sole discretion. Applicable taxes and local
government charges may be added and collected where required by law. Current will
charge the Rider’s authorized payment method (credit card, debit card, or other approved
method) for all amounts due, including any recurring payments selected by the Rider.
5.2 Referral and Promotional Codes
(a) Current may offer referral or promotional codes (“Promo Codes”) at its sole discretion.
Promo Codes:
(i) Must be used only for their intended audience and purpose, in a lawful
manner;
(ii) May not be duplicated, sold, or transferred unless explicitly authorized
by Current;
(iii) May be disabled at any time by Current without notice or liability;
(v) Are not redeemable for cash;
(vi) May be subject to expiration dates, usage limits, and other terms.
(b) Current reserves the right to withhold or cancel benefits obtained through improper,
unauthorized, or fraudulent use of Promo Codes.
5.3 Maximum Rental Period and Late Return
(a) The maximum rental period for any Vehicle is 24 hours. The Rider must end the ride
using the Current App within that time. Riders may rent again after ending a trip.
(i) The maximum daily charge is $100 per calendar day.
(ii) Rental time is calculated from the moment the Vehicle is unlocked to the
time the ride is properly ended and confirmed through the App.
(iii) If a ride is not properly ended (due to Rider error or technical issue),
charges will continue to accrue until the ride is successfully terminated.
The Rider must report any issues ending a ride immediately via the
Current App.
(v) If a Vehicle is not returned and the ride not concluded within 48 hours, it
will be considered lost or stolen, and the Rider may be charged up to the
full replacement value of the Vehicle, in addition to administrative and
recovery fees.
(b) Additional service charges may apply for overdue rentals that are not deemed lost or
stolen.
5.4 Payment Methods and Authorization
(a) To access Current Services, the Rider must provide a valid payment method. By
providing payment information, the Rider represents that they are authorized to use the
method and authorizes Current to:
(i) Charge the payment method for all applicable fees and taxes;
(ii) Place a temporary authorization hold (a standard industry practice);
(iii) Continue billing in the event the payment method expires or is not
updated.
(b) In the event of a failed transaction, Current may retry billing using any valid method on
file and may use a third-party collection agent to recover outstanding amounts, including:
(i) Traffic or parking fines paid on the Rider’s behalf;
(ii) Service or administrative fees;
(iii) Collection costs, legal fees, and related disbursements.
(c) Riders may dispute a charge by contacting Current within 10 business days of the end of
the month in which the disputed charge occurred, and must provide details of the trip in
question.
(d) If the Rider opts in to recurring or automatic billing, this will continue until canceled in
the App or the account is terminated. Canceling payment authorization may limit access
to Current Services.
5.5 Pick-Up and Abandonment Fees
(a) If a Rider ends a ride in an unauthorized location (e.g., private property, locked area, or
inaccessible zone) and requests that Current retrieve the Vehicle, a pick-up fee may be
charged, at Current’s sole discretion.
(b) If a Vehicle is abandoned without notification, the Rider is responsible for all usage fees
until the Vehicle is recovered and deactivated, in addition to a recovery fee. All fees are
subject to change.
6. ADDITIONAL TERMS OF USE
6.1 Safety Inspection
(a) Before each ride, the Rider must perform a basic safety check of the Vehicle, including
but not limited to:
(i) Functionality and alignment of wheels;
(ii) Effective operation of brakes and lights;
(iii) Structural condition of the frame;
(iv) Adequate battery charge;
(vi) Any visible damage or unusual wear.
(b) If the Rider detects any issue or mechanical defect, the Vehicle must not be used, and the
Rider must promptly report the issue via the Current App or by contacting Current
directly.
6.2 Lost or Stolen Vehicles
(a) A Vehicle may be considered lost or stolen under the following conditions:
(i) It is not returned within the maximum rental period;
(ii) It is abandoned in a location without access;
(iii) Current has reasonable grounds to suspect theft or unauthorized use.
(b) In such cases, Current may take any action deemed appropriate, including reporting the
incident to local authorities, pursuing restitution or compensation, and seeking recovery
of administrative or replacement costs. The Rider agrees to report suspected loss or theft
immediately to Current.
6.3 Helmets and Rider Safety
(a) Current strongly recommends that Riders wear a helmet that meets approved safety
standards (CPSC, CSA, EN, ASTM, or Snell B90/B95). The Rider acknowledges:
(i) Helmet use is mandatory in many jurisdictions, including Ontario;
(ii) Current does not guarantee the effectiveness or availability of any
helmet;
(iii) Riding without a helmet is done at the Rider’s own risk;
(iv) Additional safety gear may also be advisable depending on riding
conditions.
(b) The Rider assumes all responsibility for their own safety and agrees to take reasonable
precautions when using a Vehicle.
6.4 Riding Conditions and Vehicle Routes
(a) The Rider acknowledges that:
(i) Current does not provide or maintain infrastructure (e.g., lanes, trails,
sidewalks) for Vehicle operation;
(ii) The Rider is solely responsible for choosing safe routes and operating the
Vehicle with caution;
(iii) Hazards may arise from traffic, weather, pedestrians, or terrain.
(b) Current is not liable for any injuries, accidents, or delays resulting from unsafe or
unsuitable riding routes.
6.5 Limitations on Use
(a) The Rider understands and agrees that:
(i) Current is not a common carrier and is not obligated to provide
transportation services to the general public;
(ii) Use of the Vehicles is intended only for qualified individuals who have
agreed to all terms of this Agreement;
(iii) The Vehicles are provided solely as a personal convenience and short-
term mobility option, not as an essential service or public transportation
substitute.
6.6 Personal Safety and Rider Responsibility
(a) The Rider acknowledges responsibility for their own safety. Rider agrees not to operate a
Vehicle in any conditions or manner that would pose a hazard to themselves, others, or
property. This includes, but is not limited to:
(i) Inclement weather (rain, fog, snow, ice);
(ii) Poor visibility or unsafe traffic environments;
(iii) Physical or cognitive impairments that may affect judgment or reaction
time.
(b) Rider agrees to use caution and adjust their riding behavior in accordance with the
conditions around them.
6.7 Group Rides
(a) Group Rides may be permitted via the Current App. When enabling multiple rentals, the
Rider initiating the group ride becomes the “Host” and is:
(i) Jointly and severally responsible for all Vehicles activated under their
account;
(ii) Responsible for ensuring that each guest rider (“Guest”) agrees to and
abides by this Agreement;
(iii) Liable for any injury, damage, loss, or fees incurred by Guests.
(b) The Host certifies that:
(i) All Guests meet the minimum age and licensing requirements;
(ii) Only one rider is allowed per Vehicle;
(iii) The Host assumes full financial responsibility for all rentals under the
group ride;
(iv) Any improperly parked Vehicle by a Guest is the responsibility of the
Host.
6.8 Guest Obligations
(a) Each Guest Rider must:
(i) Enter their email address into the App when joining a group ride;
(ii) Read and accept this Agreement before operating any Vehicle.
(b) Failure to comply may result in denied access to the Services, suspension, or legal
liability for both the Guest and the Host.
6.9 Drug and Alcohol Impairment
(a) Operation of a Vehicle while impaired by drugs or alcohol is strictly prohibited.
Rider acknowledges that such conduct:
(i) Constitutes an offence under the Criminal Code of Canada, including as
amended by Bill C-46 (2018, c. 21);
(ii) May result in criminal prosecution, license suspension, and penalties to
the full extent of the law;
(iii) May result in immediate termination of access to the Services.
(b) The Rider is solely responsible for ensuring they are not impaired at the time of use.
6.10 Permitted Use Only
(a) The Vehicle may only be used for lawful, personal transportation. The Rider agrees not
to:
(i) Engage in racing, stunts, mountain riding, or off-road use;
(ii) Use the Vehicle for commercial purposes (e.g., food delivery) or
financial gain;
(iii) Ride on unpaved surfaces, through water beyond normal street use, or in
unauthorized areas;
(iv) Use the Vehicle in a manner that could be deemed a nuisance, hazard, or
violation of municipal bylaws or provincial legislation.
6.11 Weight, Cargo, and Equipment Limits
(a) The maximum allowable rider weight is 240 lbs (109 kg), unless otherwise specified.
(b) Riders must not carry passengers, pets, or large items that affect balance or visibility.
(c) Nothing may be placed on the handlebars or elsewhere that obstructs safe operation.
(d) Riders assume all risk and liability for violating these restrictions.
6.12 Tampering and Unauthorized Use
(a) Riders must not:
(i) Tamper with, damage, or attempt unauthorized access to any part of a
Vehicle or its locking system;
(ii) Modify, paint, remove branding, or affix third-party materials to the
Vehicle;
(iii) Use the Vehicle outside the designated Operating Area, which includes
only authorized zones in the City of Sarnia, unless otherwise approved
by Current.
(b) Violation may result in civil liability, criminal charges, and/or a permanent ban from
Current Services.
6.13 Accidents, Reporting, and Law Enforcement Cooperation
(a) Riders must report the following immediately via the Current App or by email:
(i) Any accident, injury, theft, or damage involving a Vehicle;
(ii) Any traffic citation or violation incurred while using a Vehicle.
(b) If a personal injury or third-party property damage occurs, the Rider must file a police
report within 24 hours.
(c) Riders are liable for all resulting claims, damages, fines, and fees, including costs to
Current arising from such incidents.
(d) Insurance disclaimer: Your personal automotive insurance policy may not cover injuries
or damage involving this type of Vehicle. Contact your insurance provider to confirm.
(e) Current may cooperate with law enforcement and disclose account or usage information
as required by law or requested by authorities.
6.14 Rider Liability for Damage or Loss
(a) The Rider is responsible for returning the Vehicle in the same condition in which it was
rented, excluding normal wear and tear.
(b) If the Vehicle is:
(i) Damaged, lost, stolen, or vandalized;
(ii) Improperly parked and subsequently towed or impounded;
(iii) Misused in any way that causes damage
(c) Then the Rider may be liable for:
(i) Repair or replacement costs;
(ii) Administrative and legal fees;
(iii) Third-party claims or citations.
6.15 Electric Vehicle Notice and Battery Awareness
(a) The Vehicle is battery-powered and subject to the following conditions:
(i) Power levels decrease during use and may impact speed or functionality;
(ii) Battery status at the start of rental is not guaranteed and varies by unit;
(iii) The Rider is responsible for ensuring there is sufficient charge to
complete the intended ride;
(iv) Power may be lost at any time during use without notice.
(b) Rider assumes all risk associated with loss of power during operation.
6.16 Charging Prohibition
(a) Riders are strictly prohibited from attempting to charge any Vehicle.
(b) If a Rider charges or attempts to charge a Vehicle:
(i) They assume full responsibility for any resulting damage, injury, or loss;
(ii) Current disclaims all liability for personal injury, fire, property damage,
or equipment failure;
(iii) Rider will be liable for all related claims, damages, and legal costs,
including harm caused to others or to Current’s assets.
6.17 Mobile Device and Internet Requirements
(a) To use the Current Services, the Rider must:
(i) Have access to a compatible smartphone or mobile device;
(ii) Maintain an active internet connection to unlock, ride, and end the
Vehicle rental.
(b) Rider is responsible for:
(i) Data or roaming charges incurred;
(ii) Ensuring their mobile device has sufficient battery;
(iii) Ending the ride correctly through the Current App.
(c) Current is not liable for continued charges or fees resulting from:
(i) Device failure;
(ii) App malfunction;
(iii) Lack of connectivity or depleted phone battery.
(d) Riders are responsible for all usage fees until the ride is successfully ended.
7. BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS,
INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
7.1 Initial Dispute Resolution: If you have any concerns related to your use of a Vehicle or this
Agreement, Rider Support is available via the Current App. Both parties agree to use their best
efforts to resolve any dispute, claim, or disagreement through good faith negotiations before
initiating mediation, arbitration, or litigation.
7.2 Binding Arbitration:
(a) If the dispute cannot be resolved through the support process, and except where
prohibited by law or invalidated by a court, all claims arising out of or relating to the use
or rental of a Vehicle, this Agreement, or the parties’ relationship shall be resolved
exclusively by binding arbitration. Arbitration shall be conducted under the UNCITRAL
Arbitration Rules and the National Arbitration Rules of the ADR Institute of Canada,
Inc., or another mutually agreed arbitration service, excluding any rules or procedures
allowing for class or representative actions.
(b) The arbitrator shall have exclusive authority to decide on all issues regarding the
interpretation, applicability, enforceability, or formation of this Agreement, including any
challenges to arbitration itself. The arbitrator may grant any relief available in court or
equity. The arbitrator’s written award shall be final, binding, and may be entered as a
judgment in any court of competent jurisdiction.
(c) If the arbitration filing fee exceeds the cost of filing a lawsuit, Current will pay the
additional cost. Arbitration may limit discovery and could be more costly than litigation.
The parties understand these trade-offs and knowingly agree to arbitration.
7.3 Location: Arbitration shall be held in Toronto, Ontario, or another mutually agreed location.
7.4 Class Action Waiver: To the fullest extent permitted by law, you agree to resolve disputes
individually. You and Current raise your right to participate in class actions, subject to statutory
rights that cannot be waived under Ontario or federal law. If a court or arbitrator invalidates this
waiver, the arbitration provision will be void, and the parties agree not to arbitrate disputes. If this
waiver is deemed unenforceable, any class action or collective action must be brought before the
Ontario Superior Court of Justice.
7.5 Litigation Exceptions: Notwithstanding arbitration, either party may initiate litigation in
provincial court to protect intellectual property rights (patents, copyrights, trademarks, trade
secrets, but excluding privacy or publicity rights) or pursue claims within small claims court
jurisdiction.
7.6 Right to Opt Out: You may opt out of the arbitration and class action waiver by sending written
notice within 30 days of the effective date or your first use of the Service (whichever is later) to:

neither party will be bound by these provisions.
7.7 Changes to Arbitration Section: Current will provide prior written notice of changes to this
section, which will apply prospectively. For disputes not subject to arbitration, both parties submit
to the exclusive jurisdiction of the provincial courts in Toronto, Ontario, and waive jurisdictional
and venue defenses.
8. RELEASES, DISCLAIMED, ASSUMPTION OF RISK
8.1 In exchange for use of Current Services and Vehicles, you release, indemnify, and hold harmless
Current, its affiliates, employees, contractors, officers, directors, and all related parties (the
“Released Persons”), including municipalities and property owners involved in the service, from
liability for all claims arising from your use of the Vehicles or Services, except for claims arising
from gross negligence or willful misconduct by Released Persons.
8.2 “Claims” include all liabilities, demands, damages, losses, costs, and expenses, including
attorney’s fees, related to the use of Vehicles or Services.
8.3 All Vehicles and Services are provided “as is” without warranties, express or implied, including
merchantability or fitness for a particular purpose.
8.4 You assume all risks associated with use of the Vehicles and Services, including risks from other
vehicles, pedestrians, road and weather conditions, failure to follow laws, failure to perform
safety checks, failure to wear required helmets, and negligent acts by any party.
8.5 You waive any unknown claims and agree that this release applies to all claims to the fullest
extent permitted by law.
8.6 You specifically release the City of Sarnia from any claims related to your use of Current
Services within the city. Current may provide proof of your acceptance of this Agreement to the
City upon request.
8.7 Current may suspend or terminate the service at any time without notice.
8.8 You must promptly report damage or malfunction via the Current App. Current may request the
return or replacement of Vehicles. You may be charged for damages caused by you, including
vandalism or theft, up to the full value of the Vehicle plus fees. Normal wear and tear is excluded.
8.9 If you choose to charge a Vehicle, you assume all related risks. Current and Released Persons are
not liable for any injury or damage arising from charging.
8.10 Rental fees are as specified in the Current App and are non-refundable. Fees begin when the
Vehicle is delivered and continue until rental termination or cancellation.
8.11 Nothing in this Agreement limited your rights under the Consumer Protection Act, 2002 (Ontario)
or any other provincial or federal consumer protection legislation that cannot be waived.
8.12 To the fullest extent permitted by law, liability is limited to $100 CAD or the amount paid in the
past six (6) months, whichever is greater. This limitation does not apply to claims involving death
or personal injury caused by negligence, fraud, or willful misconduct, or liability that cannot be
exclusive under the Occupiers’ Liability Act or Negligence Act (Ontario).
9. GENERAL PROVISIONS
9.1 Waiver and severability: No waiver of any breach shall constitute a waiver of any other breach.
Each provision of this Agreement is severable; if any provision is found invalid or unenforceable,
the remained shall remain in full effect.
9.2 Cumulative remedies: All rights and remedies under the Agreement are cumulative and non-
exclusive, and use of one remedy shall not preclude any other available remedies at law or equity.
9.3 Contract interpretation: Headings are for convenience and do not affect interpretation, “Or” is
inclusive, and “including” means “including, but not limited to.” Singular and plural terms apply
interchangeably, and all pronouns include masculine, feminine, and neuter forms.
9.4 Final Agreement – Modifications: This Agreement constitutes the entire agreement between you
and Current and supersedes prior agreements. Current may amend or modify this Agreement at
any time without your consent. Continued use after changes constitutes acceptance. Current will
post notices of changes on the Website or App. Pricing on the Website or App supersedes any
terms in this Agreement.
9.5 Volunteer execution: You acknowledge that you have read, understand, and voluntarily enter into
this Agreement, including all releases and disclaimers contained herein.
9.6 Account registration and security: By registering an account, you consent to receive electronic
communications in accordance with the Electronic Commerce Act, 2000 (Ontario) and applicable
anti-spam laws.
9.7 Payment terms: All changes will be displayed in Canadian dollars (CAD), inclusive of applicable
federal and provincial taxes. If you reside in Ontario, you may have rights under the Consumer
Protection Act, 2002, including rights related to recurring billing, cancellation rights, and
disclosure of fees. Nothing in these Terms limit those statutory rights.
9.8 Governing law: These Terms are governed and construed in accordance with the laws of the
Province of Ontario and the federal laws of Canada applicable therein.
9.9 Dispute resolution: Subject to any rights you may have under the Consumer Protection Act, 2002
(Ontario) or other applicable laws that provide for court proceedings, you and Current agree that
all disputes shall be resolved through final and binding arbitration, administered by Arbitration
Place or another mutually agreed-upon Canadian arbitration service, in Toronto, Ontario.
Arbitration does not apply to consumers where prohibited by law. If you are a consumer residing
in Ontario, you may have the right to resolve disputes in court of competent jurisdiction rather
than through arbitration.
9.10 Disclaimer or Warranties: Nothing in this Agreement limited your rights under the Consumer
Protection Act, 2002 (Ontario) or any other provincial or federal consumer protection legislation
that cannot be waived.
9.11 Rights under Ontario Law: If you are a consumer residing in Ontario, you may have certain
rights under the Consumer Protection Act, 2002, including rights related to cancellation, unfair
practices, and disclosure of key terms. These rights cannot be waiver or limited by this
Agreement. If any provisions of this Agreement conflicts with your statutory rights, such
provision shall not apply to the extent of the conflict.
